Terms of Service

1. Who we are, and what these terms are
StemMap ("StemMap", "we", "us", "our") is operated by Shay Ben Tolila, Osek Patur, business registration number 026487967, of Snir 39, Pardes Hanna-Karkur, Israel.
These Terms of Service ("Terms") govern your use of https://stem-map.com and everything on it (the "Service").
By using the Service, or by creating an account, you accept these Terms. If you do not accept them, do not use the Service.
Nothing in these Terms derogates from any mandatory provision of law, including the Consumer Protection Law, 5741-1981. Where these Terms conflict with a mandatory legal provision, the law prevails.
Words in the masculine include the feminine, and the singular includes the plural.
2. What StemMap is — and what it is not
Please read this section. It is the most important part of these Terms.
2.1 What it is
StemMap is a professional reference tool for practitioners and students of classical Chinese medicine. It takes a date of birth and renders the corresponding Stems & Branches (Gān Zhī / Wǔ Yùn Liù Qì) constitutional map: a five-element wheel and a set of analysis tables.
The maps are pre-computed from classical source tables and reproduced. The Service performs a lookup, not a live derivation.
2.2 What it is not
StemMap is not a medical device. It is not registered, certified or approved as one in any jurisdiction, and must not be used as one.
StemMap does not diagnose, treat, cure or prevent any condition. It does not provide medical advice, and it produces no recommendation about any person's health.
StemMap is not a substitute for professional judgement, examination, diagnosis or treatment. A constitutional map is a reference framework within a traditional system. What you do with it is entirely your clinical responsibility as a qualified practitioner.
StemMap is not for patients or the general public. It is a professional tool intended for practitioners and students. It is not intended for self-diagnosis or self-treatment by any individual.
2.3 On the accuracy of the maps
We take accuracy seriously, and we describe our method openly at /the-method.
At the same time, you must understand what our accuracy claim actually covers:
- The wheel — stems, branches, layers, organ placements, dots and corrective energy — is derived by rule from classical lookup tables, and every one of the 240 stored maps reproduces exactly from those rules.
- The five analysis tables are not rule-derived. They were transcribed from classical source documents and are reproduced as recorded, because their derivation rules are not fully documented in the available literature.
We do not warrant that the maps are free of error, nor that they match every teaching lineage or textual tradition. Stems & Branches is a traditional system with variant transmissions, and reasonable practitioners disagree. You are responsible for verifying any map before relying on it clinically.
3. Who may use the Service
You may use the Service only if you are at least 18 years old and legally able to enter into a binding contract.
The Service is intended for qualified practitioners and students of Chinese medicine. By using it you confirm that you are using it in a professional or educational capacity, and not for self-diagnosis or self-treatment.
If you are using it on behalf of a clinic, school or company, you confirm you are authorised to bind that organisation, and "you" means that organisation.
4. Your account
You must give accurate registration information and keep it current. You are responsible for everything that happens under your account, and for keeping your password confidential. Tell us immediately at shaybento@mmpguru.com if you suspect unauthorised access.
Do not share your account. Each account is for one practitioner. If you need access for several practitioners or a class, contact us about a group arrangement.
We may suspend or close your account if you breach these Terms, if you give us false information, if your use harms the Service or another user, or if we are required to by law.
5. Plans, prices and payment
5.1 Plans
Free — 3 complete maps per calendar month. No saving.
Practitioner — 15 complete maps per calendar month, patient library, clinical notes, visit history, and print and clinic-branded PDF export. Billed monthly.
Lifetime — a one-time payment granting unlimited maps and all Practitioner features, plus adjustable label positions. It does not renew and does not expire.
Current prices, allowances and features are those shown on the pricing page at the time of purchase. We may change plans, prices and allowances, and will give existing subscribers reasonable notice before a change affects them.
5.2 Payment
Payments are processed by Allpay (allpay.co.il). By purchasing, you also accept Allpay's terms. We never receive or store your card details.
You confirm you are authorised to use the payment method. If a payment fails or is reversed, we may suspend paid features until it is resolved.
5.3 Renewals
Monthly Practitioner subscriptions renew automatically each month until you cancel.
Lifetime does not renew — it is a single payment with no expiry.
5.4 Taxes
Prices are stated on the pricing page. VAT is applied where required by Israeli law. You are responsible for any other taxes or duties in your own country.
6. Cancellation and refunds
6.1 Your statutory cancellation right
If you are a "consumer" under the Consumer Protection Law, 5741-1981, you may cancel a distance transaction under section 14C(c) within 14 days of the transaction, or of receiving the required transaction document, whichever is later.
That period extends to four months if you are a person with a disability, a senior citizen or a new immigrant, provided the transaction involved a conversation with us — including by electronic communication.
Where the transaction is for an ongoing service, cancellation rights under section 13 and the Consumer Protection (Cancellation of a Transaction) Regulations, 5771-2010 apply, including any permitted cancellation fee — which will not exceed 5% of the transaction value or NIS 100, whichever is lower.
To cancel, email shaybento@mmpguru.com with your name, the email on the account, and what you are cancelling.
6.2 Cancelling a subscription generally
You may cancel at any time from your billing settings or by emailing us. Cancellation takes effect at the end of your current paid period. You keep paid access until then, and we do not charge you again.
We do not generally give partial refunds for an unused part of a period, except where the law requires it or where we have failed to provide the Service.
6.3 What happens to your data when you cancel
Your patient records are not deleted. Your account reverts to the free plan and you keep access to everything you have already saved. You can export all your data at any time, including after cancelling.
7. Acceptable use
You may not:
- use the Service for any unlawful purpose, or in breach of any professional or regulatory duty that applies to you;
- present the Service, or any map from it, as medical advice, diagnosis or treatment to a patient or the public;
- resell, sublicense, rent or redistribute the Service or its content without our written permission;
- copy, scrape, harvest or bulk-extract the map data, the lookup tables, or any other content;
- attempt to reverse-engineer, decompile or derive the underlying data set;
- circumvent any usage limit, paywall, access control or security measure;
- probe, scan or test the security of the Service, or interfere with its operation;
- upload malicious code, or anything unlawful, defamatory or infringing;
- use automated means to access the Service, except a search engine indexing public pages;
- create an account for anyone else, or share credentials.
We may investigate suspected breaches and suspend access while we do.
8. Your responsibilities when you store patient information
This section matters, and it is not boilerplate.
If you save patient records, you are entering personal information about people who are not our users. In law:
- You are the data controller for that information. We are only the processor, acting on your instructions.
- You must have a lawful basis to collect and store it.
- You must inform your patients that you use third-party software to hold their records, and obtain any consent required by the law of your country or by your professional body.
- You are responsible for the accuracy of what you enter.
- You must handle your patients' requests to see, correct or delete their records.
- You must not enter more information than you need. Do not enter contact details, identity numbers, or clinical information beyond what the tool requires.
If you are subject to the GDPR, the UK GDPR, HIPAA or an equivalent regime, you may need a written data processing agreement with us before storing patient information. Contact us and we will provide one.
You indemnify us against any claim arising from patient information you enter, including any claim that you lacked a lawful basis, consent or authority to enter it.
9. Intellectual property
9.1 Ours
The Service — including its software, design, text, layout, the StemMap name and logo, and the compiled map data set — is owned by us or licensed to us, and is protected by intellectual property law.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own professional or educational purposes, for as long as your account is active and these Terms are observed. No other rights are granted.
The underlying classical method is a traditional body of knowledge that we do not claim to own. Our rights are in our compilation, arrangement, verification and presentation of it, and in our software.
9.2 Yours
You keep all rights in the content you enter — patient records, notes and visit history. We claim no ownership of it.
You grant us only the limited licence needed to host, store, process and display that content back to you in providing the Service. That licence ends when you delete the content or close your account, subject to backup retention periods.
9.3 Output
Maps you generate are yours to use in your practice, including in patient files and printed materials. You may not redistribute the map data set itself, or build a competing product from it.
10. Availability
We aim to keep the Service available but we do not guarantee uninterrupted or error-free operation. We may suspend it for maintenance, updates, or reasons beyond our control, and we may modify or discontinue features.
If we discontinue the Service entirely, we will give you reasonable notice and an opportunity to export your data, and will refund the unused portion of any prepaid period.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Service will meet your requirements, that it will be uninterrupted, secure or error-free, or that any defect will be corrected.
Nothing in this section limits any right you have under mandatory consumer protection law.
12. Limitation of liability
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, special, consequential, punitive or exemplary loss; nor for loss of profit, revenue, goodwill, business or data; nor for the cost of substitute services — however caused, and whether or not we were advised such loss was possible.
We are not liable for any clinical decision made by you or anyone else on the basis of a map, or for any outcome of any treatment.
We are not liable for loss or corruption of data you have not backed up, nor for the acts or omissions of third-party providers including our hosting and payment providers.
Our total aggregate liability arising out of or relating to the Service, on any basis whatsoever, is limited to the amount you actually paid us in the twelve months immediately before the event giving rise to the claim — or NIS 500, whichever is greater.
Nothing in these Terms excludes or limits liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected.
13. Indemnity
You will indemnify and hold us harmless against any claim, demand, loss, liability, damage, cost or expense — including reasonable legal fees — arising from: your use of the Service; your breach of these Terms; your breach of any law or professional duty; any patient information you enter; and any clinical decision you or anyone else makes using the Service.
14. Term and termination
These Terms apply while you use the Service.
You may stop at any time and close your account from your settings.
We may suspend or terminate your access if you breach these Terms, if your use creates risk or legal exposure for us or others, or if we are required to by law. Where practical we will give notice and an opportunity to remedy.
On termination your licence ends immediately. Sections 2, 8, 9, 11, 12, 13, 15 and 16 survive.
You may export all your data at any time, including after termination, for as long as we retain it under our Privacy Policy.
15. Governing law and jurisdiction
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules.
The competent courts of Hadera, Israel, have exclusive jurisdiction over any dispute — except that if you are a consumer resident elsewhere, you may also bring proceedings in the courts of your own country where mandatory local law gives you that right.

16. General
Changes. We may amend these Terms. Material changes will be posted on the website, and we will notify account holders by email before they take effect. Continued use afterwards constitutes acceptance. If you do not accept a change, stop using the Service and close your account.
Severability. If a provision is held invalid, the rest remains in force and the invalid provision is replaced by a valid one closest to its intent.
No waiver. Not enforcing a provision does not waive it.
Assignment. You may not assign these Terms. We may assign them on a merger, acquisition or sale of assets, on notice to you.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us regarding the Service.
Errors. If an obvious error appears in a price or description — for example a clear typographical mistake — we may correct it and cancel any affected transaction, refunding you in full. You may not require us to honour an obviously erroneous price.
Notices. We may contact you by email at the address on your account. A notice sent by email is deemed received within 7 days.
Force majeure. We are not liable for failure to perform caused by events beyond our reasonable control.
